Agreement and operator
These Terms govern use of the Thynkr app and related services operated by Miguel Fierro Muñoz (“Thynkr,” “we,” “us,” or “our”). By downloading, accessing, or using Thynkr, you agree to these Terms and Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), available from Apple Legal. If you do not agree, do not use Thynkr.
Eligibility
You must be at least 16 years old and legally able to enter into these Terms. Thynkr is not directed to children under 16. You must provide accurate eligibility and account information and keep sign-in credentials secure.
The service and safety boundary
Thynkr provides guided-thinking rituals, prompts, progress features, optional nudges, reminders, account sync, and features that may change. Some capabilities require a supported device, internet connection, signed-in account, permission, subscription, or specific country availability.
Thynkr is a reflection tool. It is not an emergency or crisis service and does not provide medical, mental-health, legal, financial, or other professional advice. You remain responsible for your decisions and actions.
Accounts and deletion
You may use certain features as a guest. Guest information may exist only on your device and may be lost if you delete the app or device data.
A connected account uses Sign in with Apple and Supabase-backed sync. You are responsible for activity under your account. You may delete a connected account in Settings. Account deletion does not cancel an App Store subscription. See the Privacy Policy and account deletion page for scope and retention exceptions.
Subscriptions
Deep Thynkr may be offered as an auto-renewable monthly or annual subscription. The intended United States reference prices are US$4.99 per month and US$49.99 per year. The App Store purchase sheet controls the actual price, currency, taxes, billing period, and offer for your storefront.
Payment is charged to your Apple Account when you confirm purchase. A subscription renews automatically unless you cancel it through your Apple Account subscription settings at least 24 hours before the end of the current period. Apple may charge renewal within 24 hours before that period ends. You can restore eligible purchases in Thynkr.
Apple handles billing, cancellation, and refund decisions. Deleting Thynkr or deleting a Thynkr account does not cancel the subscription.
Eligible new subscribers may receive a 14-day free trial on the annual plan. The Apple purchase sheet states whether you are eligible, the exact trial duration, the price charged after the trial, and the renewal terms. Unless you cancel before the trial ends, the annual subscription renews at the then-current regular storefront price shown by Apple. The monthly plan does not include this annual-plan trial.
User content
You retain ownership of conclusions, reflections, custom questions, and other content you create. You grant Thynkr a limited, non-exclusive license to host, copy, transmit, format, and process private content only as necessary to provide sync, recovery, security, and features you request.
If you deliberately offer a thought to Ether or another shared feature, you grant Thynkr a worldwide, non-exclusive, royalty-free license to host, reproduce, distribute, display, moderate, and remove it for that feature. An accepted Ether copy may be dissociated from the account and remain after account deletion, but may still be removed for safety, law, moderation, or personal-information leakage.
Do not submit content you lack the right to share or another person's confidential or identifying information without permission.
Acceptable use
You must not use Thynkr unlawfully; harm, threaten, harass, exploit, or impersonate anyone; submit illegal, hateful, sexually exploitative, malicious, deceptive, or privacy-invasive content; discover another user's private content; bypass access controls, quotas, subscriptions, or security; overload or scrape the service; or infringe intellectual-property, privacy, publicity, or other rights.
Do not treat a generated nudge as professional advice or represent it as a verified fact.
Shared-content moderation
When shared features are enabled, users can report or block content or participants through available controls. Thynkr may review, restrict, remove, retain as evidence, or report content and may suspend or terminate access for safety, legal compliance, service integrity, or enforcement.
Miguel Fierro Muñoz is the moderation and escalation owner. Moderation is judgment-based and no outcome is guaranteed. Email thynkrapp@gmail.com for an appeal or concern without including unrelated private reflections.
AI-generated nudges
Nudges are brief prompts intended to open reflection. They can be incomplete, inappropriate, or wrong and are not facts or advice. Thynkr may use an Apple on-device model, a limited Google Gemini cloud request for signed-in users, or a built-in prompt. The Privacy Policy describes processing.
Availability, suspension, and changes
Thynkr may change, suspend, or discontinue features, limits, availability, or beta functionality. We do not guarantee uninterrupted or error-free operation. We may restrict or terminate access for a material or repeated breach, security risk, abuse, legal requirement, or harm to users or the service, with notice and an opportunity to appeal where reasonable and lawful.
Disclaimers and liability
The Apple Standard EULA supplies the platform license, warranty, support, product-claim, intellectual-property, export, and third-party-beneficiary terms required for the licensed app.
To the maximum extent permitted by law, Thynkr and related services are provided “as is” and “as available.” Thynkr does not warrant that a prompt, nudge, sync result, reminder, or shared item will be accurate, complete, available, or suitable for a decision.
To the maximum extent permitted by law, the operator is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, or decisions made from app content. Nothing excludes liability or consumer rights that cannot legally be excluded.
Governing law and disputes
These Terms are governed by the laws of Mexico, without depriving you of mandatory consumer protections where you live. Courts with lawful jurisdiction in the State of Mexico may hear disputes unless mandatory law provides another forum.
Before filing a claim, you and Thynkr agree to try to resolve the issue by emailing thynkrapp@gmail.com. This does not prevent urgent relief or use of a regulator, consumer authority, small-claims process, or another right that cannot be waived.
Changes and contact
Thynkr may update these Terms. A revised version will carry a new effective date, with additional notice or consent where required.
